DEPARTMENT OF EDUCATION REGULATION 250
Public notice is hereby given to students who are 18 years of age or older (“Eligible Students”), to other persons enrolled in a post-secondary education institution (“Former Students”), and to parents or legal guardians, relative caregivers (“Parents”) of students who are less than 18 years of age of their rights under the Family Education Rights and Privacy Act and Department of Education Regulation 250 to: (1) Inspect and review their own or their children’s education records; (2) Attain copies of education records; (3) Receive an explanation of interpretation of the education records from appropriate instructional or administrative staff; (4) Seek the correction of education records through a written request to amend, upon the belief that information in the education records collected, maintained, or used by the District is (1) inaccurate, (2) misleading, or (3) violates the privacy or other rights; (5) Be informed, in writing, if a request to amend the education records is denied and the reason for the denial; (6) Have a formal hearing if the request to amend the records is denied; (7) Be permitted to place a statement in the education records if the request continues to be denied after the formal hearing; (8) Request a copy of any Christina School District policies and written procedures concerning education records; and (9) File complaints concerning alleged failure of Staff to comply with the requirements of this Policy. Eligible Students, Former Students and Parents may waive any of the listed rights. Such waiver is not valid unless it is in writing and signed by Parents, Former Student, or Eligible Student and forwarded to the District Officer listed below. Information regarding the District’s policy and procedures on student records is available through the Department of School Operations.
Personally identifiable information from education records shall not be disclosed to third parties without the written consent of Parents, Former Students, or Eligible Students, except under those circumstances recognized by law and Regulation 250. “Directory Information,” includes, but is not limited to, a student’s name, address, telephone listing, date and place of birth, major field of study, participation in officially recognized activities and sports, weight and height of members of athletic teams, dates of attendance, degrees, and awards received, pictures of in school activities (i.e. yearbook pictures), video or print images for school district purposes, and the most recent previous educational agency or institution attended by the student, and other similar information, disclosed to third parties without consent of Parents, Former Students, or Eligible Students. Parents, Former Students, or Eligible Students may designate other types of personally identifiable information as “Directory Information,” writing to the District Officer listed below.
Any person 18 years of age or older, any students enrolled at a post-secondary education institution, and any parent or guarding of a student who is less than 18 years of age who does not wish to permit the release of such “directory information” shall notify in writing the District officer listed below on or before October 7, 2022. Failure to do so shall be considered to be authorization to release such “Directory Information” as may be deemed appropriate by the Christina School District.
